The abolition of the “National Security Law” , one of the legacies of the Cold War, the national division, and dictatorial domination, is central of any effort to right the wrongs of the past. \ubbf8\ub798\ub97c \uc704\ud55c \uc720\uc77c\ud55c \uc120\ud0dd\uc740 \uad6d\uac00\ubcf4\uc548\ubc95 \ud3d0\uc9c0\ub2e4. Even the ruling clique of the past and its allies in the conservative elite establishment media, which have dotted on the “National Security Law” as their most favoured treasure and wielded it wildly to defend their privileges and power, are, forced by a ground swelling of the public pressure for its abolition, mooting the idea of its amendment or replacement legislation. \uadf8\ub4e4\uc740 \uc5ec\uc804\ud788 \ubd81\ud55c\uc744 꺓\u819a\ubb3c\u3008\u5831펲\ub77c \uc8fc\uc7a5\ud558\uba70 \uc548\ubcf4\ub97c \ube4c\ubbf8\ub85c \uad6d\ubbfc\ub4e4\uc5d0\uac8c \ub9c9\uc5f0\ud55c \ubd88\uc548\uac10\uc744 \uc2ec\uc5b4\uc8fc\uba74\uc11c, \uc774\ubbf8 \ub1cc\uc0ac\uc0c1\ud0dc\uc778 \uad6d\uac00\ubcf4\uc548\ubc95\uc758 \ubaa9\uc228\uc744 \uc5f0\uc7a5\ud558\ub824 \ud55c\ub2e4. They, however, insist of agitating the undefined fears of the people by exploiting “security” concerns and attacking north Korea as an “anti-state organisation”. This their attempt to keep the “National Security Law”, which has long entered a ‘brain-dead’ state, alive. \ud558\uc9c0\ub9cc, \uad6d\uac00\ubcf4\uc548\ubc95\uc740 \uc544\ubb34\ub9ac \uc190\uc9c8\ud574\ub3c4, \uc124\ub839 \uac1c\uba85\ud55c\ub2e4\uace0 \ud558\ub354\ub77c\ub3c4 \ucc38\ud639\ud55c \uacfc\uac70\uc758 \uae30\uc5b5\uc744 \ub36e\uc744 \uc218\ub294 \uc5c6\ub2e4. The fact remains, however, that whatever amendments or cosmetic surgery that can be done to the “National Security Law, it cannot wipe out the memory of the brutal and barbaric past that it had marshalled.<\/p>\n

Abolish the “National Security Law”! If the 17th National Assembly hopes to be remembered as the second “Constitutional Assembly”, the abolition of the “National Security Law” is the central historical task it must accomplish. \uc81c17\ub300 \uad6d\ud68c\ub294 \ub300\ud1b5\ub839 \ud0c4\ud575\uc774\ub77c\ub294 \ucd08\uc720\uc758 \uc0b0\uace0\ub97c \uacaa\uc73c\uba70 \uad6d\ubbfc\ub4e4\uc758 꺖\uad45\ud0ed\u77d7?\uc744 \ud1b5\ud574 \ud0c4\uc0dd\ud588\ub2e4. The 17th National Assembly came into being on the basis of an ‘electoral revolution’ powered by the people who rose to overcome the devastation heralded by the attempted impeachment of the President of the Republic. \uadf8\ub4e4\uc774 \uc9c4\uc815 \uc624\uc810\ud22c\uc131\uc774\ub85c \uc810\ucca0\ub41c \uacfc\uac70 \uad6d\ud68c\uc640\uc758 \ub2e8\uc808\uc744 \uc120\uc5b8\ud558\uace0 \uc81c2\uc758 \uc81c\ud5cc\uad6d\ud68c\ub85c \uac70\ub4ed\ub098\uace0\uc790 \ud55c\ub2e4\uba74, 1948\ub144 12\uc6d4 1\uc77c \uc81c\ud5cc\uad6d\ud68c\uac00 \uc798\ubabb \ub07c\uc6b4 \uccab\ub2e8\ucd94, \uad6d\uac00\ubcf4\uc548\ubc95\ubd80\ud130 \ubc18\ub4dc\uc2dc \ud3d0\uc9c0\ud574\uc57c \ud55c\ub2e4. If the 17th National Assembly indeed intends to cut ties with the tainted National Assemblies of the past and establish itself as the second Constitutional Assembly, then its work should begin with the abolition of the “National Security Law”, righting the wrongs of the Constitutional Assembly on December 1, 1948. <\/p>\n

\nHistory of the National Security Law<\/p>\n

It would no exaggeration to state that the “National Security Law” was enacted by the authoritarian government for political exploitation. 1949\ub144 \uad6d\uac00\ubcf4\uc548\ubc95 \uc81c\uc815\uc5d0 \ubc18\ub300\ud558\ub358 13\uba85\uc758 \uad6d\ud68c\uc758\uc6d0\uc774 \uad6d\uac00\ubcf4\uc548\ubc95 \uc704\ubc18\uc73c\ub85c \ucc98\ubc8c\ub418\ub294 \uc18c\uc704 꺊\ubbc4\ub9e8\uc870\u91e7 \uc0ac\uac74꽵 \uadf8 \uc545\uc6a9\uc758 \uc5ed\uc0ac\uac00 \uc774\ud6c4 \uc5b4\ub5bb\uac8c \uc804\uac1c\ub420 \uac83\uc778\uc9c0\ub97c \ub2e8\uc801\uc73c\ub85c \ubcf4\uc5ec\uc900 \uc0ac\ub840\uc600\ub2e4. The indictment of 13 members of the National Assembly, who had opposed the enactment of the National Security Law, for alleged violation of the Act — a case that has come to be known under the name of ‘National Assembly Fraction Case’ — was a prime early example which foreshadowed how the law would be abused in the days to come. \ub610\ud55c \uad6d\uac00\ubcf4\uc548\ubc95\uc740 \uc804\uc2dc\uc640 \uac19\uc740 \uad6d\uac00\ube44\uc0c1\uc2dc\uae30\uc758 \uc784\uc2dc\uc801 \ud55c\uc2dc\ubc95\uc73c\ub85c\uc11c 5\ub144 \ud6c4 \ud615\ubc95\uc744 \uc81c\uc815\ud560 \ub54c \ud3d0\uc9c0\ud558\uae30\ub85c \uc57d\uc18d\ub418\uc5c8\ub358 \ubc95\ub960\uc774\uc5c8\ub2e4. The National Security Law, however, was not repealed, but gained greater power as it was became the central instrument for sustaining the ruling regime in power.<\/p>\n

\nLegal Problems of the National Security Law<\/p>\n

The National Security Law contradicts the provision for “peaceful reunification” enshrined in the Constitution (the Preamble, Articles 4, 66, and 69), the principle of “nullum crimen sine lege” (that there can be no crime without a law” defined in the Article 12, the provisions for “freedom of conscience” (Article 19) and “freedom of speech” (Article 21), and the principle of “equality before the law” (Article 11), the provision for “human worth and dignity” (Article 10), and is in contravention to the principle of “rule of law” and the principle of prohibition of “excessive restriction” (Article 37:2), and oversteps the limit of the right and power of the National Assembly to enact laws (Article 40). In summary, the National Security Law is a law that stands in violation of the Constitution.<\/p>\n

\nThe Damages Wrought by the National Security Law<\/p>\n

In the process, the Act was used to violate the basic rights of not only those people who were involved in the democratisation movement, but ordinary people. The Article 3 of the Constitution of the Republic of Korea (The territory of the Republic of Korea shall consist of the Korean peninsula and its adjacent islands), which defines the territory of the Republic does not contradict the Article 4 (The Republic of Korea shall seek unification and shall formulate and carry out a policy of peaceful unification based on the principles of freedom and democracy), which embraces the principle of peaceful reunification.<\/p>\n

The insistence on this view makes any improvement in the relationship with North Korea impossible.<\/p>\n

The Constitution and the Criminal Code of North Korea do not contain any provision which deny the reality of South Korea or define it as an “Anti-State Organisation”. North Korea’s programme for socialist construction is also limited to the spatial boundary of North Korea. <\/p>\n

North Korea has repeated called for its repeal, and as such, it has been one of the main cause of the heightening of tension between South and North Korea.<\/p>\n
