The Constitutional Court of Korea, in its decision of 29 August 2024 (Case No. 2020Hun-Ma389 and consolidated cases), became the first apex court in Asia to rule on the merits of a climate case, affirming that responding to the climate crisis is a constitutional duty of the State owed to the protection of fundamental rights. The Court held that States&#8217; discretion in determining their NDCs is confined to what is capable of achieving the scientifically based consensus target of 1.5\u00b0C, and that NDCs must reflect the outcomes of the Global Stocktake, the principle of common but differentiated responsibilities and respective capabilities, and the obligation to pursue the highest possible ambition. This popular mandate converges precisely with the normative direction established by the Constitutional Court and the ICJ Advisory Opinion.
